New Doctoral Dissertation of Law Science Doctoral Program FH UNUD Raises the Topic of Kenotariatan

Denpasar, FLUNUD.ac.id - Ketut Harta Yasa, a Notary / PPAT in Badung Regency successfully completed his Doctoral studies at the Doctoral Program (S3) of Law Science FH UNUD through an Open Session on Tuesday (03/14/2022) at the FH UNUD Hall, Denpasar Campus with the dissertation title "The Nature of Notary Peace Deed in the Reconstruction of Collateral Taken Over (AYDA)."

The Open Session was chaired by the Dean of FH UNUD (Prof. Dr. Putu Gede Arya Sumerta Yasa, S.H., M.Hum), attended by the Promoter Team (Prof. Dr. Ibrahim R., SH., MH., Dr. I Gede Artha, SH., MH., Dr. I Made Sarjana, S.H., M.H.) and 4 other examining lecturers. The 3 problem formulations discussed in Dr. Ketur Harta Yasa's dissertation are: (1) What is the nature of the Notarial Deed of Peace in the settlement of bad debts with repossessed collateral that is fair; (2) 2. What is the character of the Deed of Peace in the reconstruction of repossessed collateral so that it is able to have legal force; (3) 3. What are the legal reasons for the Notarial Deed of Peace stated that it is final, binding; and as a modern legal product?.

The results of the dissertation show that the Notary Peace Deed is final and binding because it contains a statement that the parties will not make any legal efforts in the future; so that in the future the settlement of bad debts by means of Collateral Taken Over (AYDA) using a Notary Peace Deed is the best solution and at the same time has fulfilled the criteria as the characteristics of modern law based on Pancasila, namely fulfilling the criteria of facilitative, accommodative, adaptive, bottom-up and futuristic legal products.
