PDIH FH UNUD Promotes New Doctor of Law in Early May 2023

Denpasar, FLUNUD.ac.id - The promotion of a new doctorate on behalf of Ni Gusti A.A. Mas Tri Wulandari by the S3 (Doctoral) Law Science Study Program (PDIH) FH UNUD was held on Friday (05/05/2023) at the FH UNUD Hall, Denpasar Campus. Ni Gusti A.A. Mas Tri Wulandari who works as a lecturer at the National Education University (Undiknas University) successfully earned her doctorate with a dissertation entitled "Mental Health Expert Assistance Arrangements for Wives as Perpetrators of Domestic Violence."

The doctoral promotion was led directly by Koprodi S3 (Doctoral) Law Science FH UNUD (Prof. Dr. I Putu Sudarma Sumadi, S.H., S.U.), accompanied by the Promoter Team: Prof. Dr. Ibrahim R., S.H., M.H., Dr. Ida Bagus Surya Dharma Jaya, S.H., M.H., Dr. Sagung Putri M.E. Purwani, S.H., M.H. and 4 other examining lecturers. Ni Gusti A.A. Mas Tri Wulandari's dissertation discussed 3 problem formulations, namely: (1) What is the philosophical basis of mental health expert assistance for wives in domestic violence crimes?; (2) How is the regulation of mental health expert assistance for wives as perpetrators of domestic violence at this time (ius constitutum)?; (3) How is the mental health expert assistance system for wives as perpetrators of domestic violence in the future (ius constituendum)?.

The results showed that the Government of Indonesia regulated the protection of women in various laws and regulations long before CEDAW was ratified by the Government of Indonesia with Law Number 7 of 1984 concerning the Ratification of the Convention On The Elimination of All Forms Of Discrimination Against Women. Mental health expert assistance as a supporting criminal justice system until now there is still no legal umbrella in the Law on the Elimination of Domestic Violence (PKDRT) or other national laws and regulations related to domestic violence. Lawmakers should harmonize the current PKDRT Law with the regulation of mental health expert assistance as a supporting criminal justice system for wives as perpetrators of domestic violence in order to create justice and balanced protection in the future (ius constituendum).
