I Putu Arwan Puspa Rismawan Earns Doctorate in Law, Raises Issue of Restructuring the Land Bank Agency’s Authority to Ensure Legal Certainty for Investments

DENPASAR – The Faculty of Law at Udayana University has once again produced a new expert in the field of law. I Putu Arwan Puspa Rismawan successfully defended his dissertation during the Open Doctoral Defense held on Thursday, July 9, 2026, beginning at 9:00 a.m. WITA. This prestigious academic event took place solemnly at the Kertha Sabha Convention Hall, Jalan Pulau Bali No. 1, Denpasar.

The open defense was presided over by the Dean of the Faculty of Law at Udayana University, Prof. Dr. Putu Gede Arya Sumertayasa, S.H., M.Hum., who served as Chair of the Session. Meanwhile, the academic defense was overseen by a committee of advisors consisting of Prof. Dr. I Wayan Parsa, S.H., M.Hum., as the Primary Advisor; Prof. Dr. Desak Putu Dewi Kasih, S.H., M.Hum., as the First Advisor; and Dr. Anak Agung Gede Duwira Hadi Santosa, S.H., M.Hum., as the Second Advisor. The defense also featured an external examiner, Prof. Dr. Suhariningsih, S.H., S.U., who was joined by four other examiners who critically evaluated the candidate’s research material.

During the defense, I Putu Arwan Puspa Rismawan presented his dissertation titled “Reconstructing the Regulatory Framework of the Land Bank Agency’s Authority in Supporting Investment.” Through his in-depth research, he concluded that the essence of the Land Bank Agency’s authority should position this institution as a guardian of land availability that actively manages state land assets. This is crucial to ensuring the availability of land for development and investment in order to achieve an equitable economy. However, he emphasized that the current framework governing the Land Bank Agency’s authority still creates legal uncertainty because it directly overlaps with the authority of the Ministry of Agrarian Affairs and Spatial Planning or the National Land Agency. Therefore, a restructuring of the regulatory framework governing land acquisition to support investment is urgently needed through a comprehensive regulatory overhaul that takes into account the hierarchy of legal norms in Indonesia without disregarding constitutional mandates.

To address these legal issues, Dr. I Putu Arwan Puspa Rismawan presented several strategic recommendations to the examining committee. He emphasized the need to strengthen the role of the Land Bank Agency in exercising oversight by granting it full authority over land acquisition policies to minimize land hoarding by unscrupulous land speculators. Furthermore, the exercise of this authority must remain within constitutional limits to prevent the emergence of constitutional defiance.
